INTRODUCTION

Welcome to FitStreak! These Terms of Service ("Terms") govern your access to and use of the FitStreak mobile application ("App"), website, and all related services (collectively, the "Services") operated by FitStreak ( "we," "our," or "us").

Please read these Terms carefully before using FitStreak. By downloading, installing, or using the App, or by clicking "I Agree," you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, do not access or use our Services.

1. ACCEPTANCE OF TERMS

By creating an account or using any part of our Services, you enter into a legally binding agreement with FitStreak. These Terms apply to all users of FitStreak, including users who access the Service through Google Sign-In or any other supported authentication method.

We reserve the right to update or modify these Terms at any time. We will notify you of material changes through the App or by email. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms.

2. ELIGIBILITY

To use FitStreak, you must meet the following requirements:

• You must be at least 13 years of age (or at least 16 if you are located in the European Economic Area or United Kingdom)
• You must have the legal capacity to enter into a binding agreement in your jurisdiction
• You must not be prohibited from using the Services under the laws of your country or region
• You must provide accurate and complete information when creating your account

If you are under the age of majority in your jurisdiction but at least 13 years old, you may only use FitStreak with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.

We reserve the right to refuse Service to anyone for any reason at any time.

3. YOUR ACCOUNT

3.1 Account Registration

To access most features of FitStreak, you must create an account. You may register using:

• Your email address and a password you create
• Your Google account via Google Sign-In

When registering, you agree to:

• Provide accurate, current, and complete information
• Keep your account information updated
• Maintain the confidentiality of your password and login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately at support@fitstreak.fit if you suspect unauthorized access to your account

3.2 One Account Per Person

Each user is permitted to maintain only one active FitStreak account. Creating multiple accounts to gain an unfair advantage in challenges, leaderboards, or rewards is a violation of these Terms and may result in all associated accounts being permanently suspended.

3.3 Account Security

You are solely responsible for maintaining the security of your account. FitStreak will not be liable for any loss or damage arising from your failure to protect your account credentials.

4. THE FITSTREAK SERVICE

4.1 What FitStreak Does

FitStreak is a fitness tracking and motivation platform that helps you build healthy walking habits through:

• Daily step tracking — Using your device's step counter sensor and Android Health Connect to count and record your daily steps
• Streak system — Tracking consecutive days you meet your personal step goal to build long-term fitness habits
• Virtual fitness events — Competitive step-based challenges where participants track progress on leaderboards and can win prizes
• Green energy feature — Converting your fitness activity into a measure of clean energy you generate, with the option to donate virtual trees
• Badges and achievements — Unlocking milestone rewards as you hit step and streak goals
• In-app coins (Fit Coins) — Earning coins through activity that can be used within the app (e.g., purchasing event tickets)
• Progress analytics — Viewing your weekly and monthly step history through charts and summaries
• Push notifications — Receiving reminders, motivational messages, and event updates

4.2 Service Availability

We strive to keep FitStreak available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance or updates
• Unexpected technical outages
• Events beyond our reasonable control (force majeure)

We will make reasonable efforts to notify you of planned downtime in advance.

4.3 Health Connect Integration (Android)

FitStreak integrates with Android Health Connect to read and write step data. By using this feature, you acknowledge that:

• You must grant the required Health Connect permissions for this feature to work
• You can revoke these permissions at any time through Health Connect settings on your device
• FitStreak accesses only step-related data and does not access medical records, diagnoses, or clinical health information
• The accuracy of step tracking may vary depending on your device hardware and settings

5. HEALTH & FITNESS DISCLAIMER

IMPORTANT — PLEASE READ CAREFULLY

FitStreak is a general-purpose fitness and wellness application. It is not a medical device, clinical tool, or substitute for professional medical advice.

• The step counts, calorie estimates, distance figures, and activity metrics provided by FitStreak are estimates only and may not be fully accurate
• FitStreak data should not be used to make medical decisions or as a substitute for the advice of a qualified healthcare professional
• Always consult a physician or qualified health provider before starting any new exercise or fitness program, especially if you have a pre-existing health condition
• FitStreak is not approved or cleared as a medical device by any regulatory body

By using FitStreak, you assume all risks associated with your physical activity and fitness choices.

6. VIRTUAL EVENTS AND REWARDS

6.1 Participation

FitStreak may offer virtual step-based events in which you can participate to compete with other users on a leaderboard. By joining an event, you agree to:

• Participate honestly using legitimate step data from your device sensor or Health Connect
• Not use any automated tools, bots, emulators, or artificial methods to inflate your step count
• Accept that your display name and step progress will be visible to other participants on the event leaderboard

6.2 Event Tickets (Fit Coins)

Some events may require purchasing entry tickets using your in-app Fit Coins. Coin purchases using Fit Coins are final and non-refundable once an event has started.

6.3 Winners and Rewards

• Winners are determined at the conclusion of each event based on step count or other stated criteria
• FitStreak reserves the right to verify the legitimacy of winning step data before awarding prizes
• If winning data is found to be fraudulent, manipulated, or in violation of these Terms, the disqualified user's reward will be forfeited and their account may be suspended
• Rewards may include physical prizes, coupon codes, monetary transfers, or in-app points, as stated in each event's description

6.4 Claiming Rewards

To claim a physical reward, winners must provide:

• A valid email address
• A valid phone number
• A complete shipping address

This information is used solely for reward delivery and is handled in accordance with our

Privacy Policy. Reward claims that cannot be fulfilled due to inaccurate information provided by the winner will be forfeited after 30 days.

6.5 No Guarantee of Rewards

FitStreak does not guarantee the availability of prizes for every event. Event reward details are subject to change and will be communicated within the App before the event begins.

7. IN-APP COINS AND GREEN ENERGY

7.1 Fit Coins

Fit Coins are virtual, in-app currency earned through step activity and used exclusively within the FitStreak platform. Fit Coins:

• Have no real-world monetary value and cannot be exchanged for cash or transferred between accounts
• Are non-refundable and non-transferable
• May expire or be adjusted if your account is suspended or terminated
• Are subject to change by FitStreak at any time, including their earning rate and redemption value within the app

7.2 Green Energy and Tree Donations

The Green Energy feature converts your step activity into a virtual representation of clean energy generated and trees planted. These are:

• Virtual metrics intended to gamify eco-friendly behavior and motivate fitness activity
• Not actual energy production or real tree-planting transactions unless specifically stated otherwise in a campaign with a verified partner
• Subject to change in how they are calculated or displayed

8. USER CONDUCT

By using FitStreak, you agree not to:

• Use any automated system, bot, script, or third-party software to artificially inflate your step count or interact with the Service in a non-human manner
• Create fake accounts, impersonate other users, or misrepresent your identity
• Attempt to gain unauthorized access to any part of the Service, our servers, or any connected systems
• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive source code from the App
• Use the Service to transmit spam, malware, or any harmful or unlawful content
• Exploit bugs, glitches, or unintended features to gain an unfair advantage
• Circumvent, disable, or interfere with security-related features of the App
• Collect or harvest data about other users without their consent
• Use the Service in any way that violates applicable local, national, or international law

Violation of these conduct rules may result in immediate suspension or permanent termination of your account without notice or refund.

9. REFERRAL PROGRAM

FitStreak may offer a referral program where you can invite others to join using a unique referral code. By participating:

• You may receive in-app rewards (such as Fit Coins) when someone signs up using your code and meets the stated referral criteria
• Referral rewards are subject to verification and may be withheld if fraudulent activity is detected
• Creating fake accounts or abusing the referral system (e.g., self-referrals) is prohibited and will result in account termination and forfeiture of all referral rewards
• FitStreak reserves the right to modify or discontinue the referral program at any time

10. INTELLECTUAL PROPERTY

10.1 Our Content

All content, features, and functionality in FitStreak — including but not limited to the app design, graphics, logos, icons, text, software code, animations, and the "FitStreak" name and brand — are the exclusive property of FitStreak and are protected by copyright, trademark, and other applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the FitStreak App for personal, non-commercial purposes strictly in accordance with these Terms.

10.2 Your Content

FitStreak may allow you to upload a profile photo or set a display name. By providing any such content, you grant FitStreak a non-exclusive, royalty-free, worldwide license to use, display, and store that content solely for the purpose of operating the Services.

You represent that:

• You own or have the necessary rights to any content you upload
• Your content does not infringe on any third-party intellectual property, privacy, or other rights

10.3 Feedback

If you submit feedback, ideas, or suggestions about FitStreak, you grant us the right to use that feedback without any obligation or compensation to you.

11. THIRD-PARTY SERVICES

FitStreak integrates with certain third-party services, including:

• Google Sign-In — Governed by Google's Terms of Service and Privacy Policy
• Android Health Connect — Governed by Google's Health Connect Terms of Service
• Firebase (Google) — Used for authentication, push notifications, and crash reporting
• Google Play — Distribution of the App is subject to Google Play's Developer Distribution Agreement

We are not responsible for the content, privacy practices, or availability of any third-party services. Your use of those services is governed by their respective terms.

12. DISCLAIMERS

12.1 "As Is" Service

THE FITSTREAK SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.

12.2 Step Accuracy

We do not guarantee that step counts, calorie estimates, or other fitness metrics are accurate. These values are estimates derived from your device's sensors and may vary based on hardware, placement, and individual factors.

12.3 No Medical Advice

Nothing in FitStreak constitutes medical advice. We are not liable for any health outcomes resulting from use of our App or reliance on any data displayed within it.

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FITSTREAK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, goodwill, or business opportunities
• Personal injury or property damage arising from your use of the Service
• Unauthorized access to or alteration of your data
• Any errors, inaccuracies, or omissions in any content

IN ALL CASES, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) INR 500 (OR THE EQUIVALENT IN YOUR LOCAL CURRENCY).

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so some of the above limitations may not apply to you.

14. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless FitStreak and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Services in violation of these Terms
• Your violation of any applicable law or regulation
• Your violation of any third-party rights, including intellectual property or privacy rights
• Any content you submit through the Services

15. TERMINATION

15.1 Termination by You

You may stop using FitStreak at any time and delete your account through the in-app account deletion option located in Settings → Account → Delete Account. Deleting your account will remove your personal data in accordance with our Privacy Policy.

15.2 Termination by FitStreak

We reserve the right to suspend or permanently terminate your account, with or without notice, if we determine that you have:

• Violated these Terms of Service
• Engaged in fraudulent, abusive, or harmful conduct
• Provided false or misleading information during registration
• Harassed or threatened other users or our staff

Upon termination, your license to use the App will immediately cease. Any accumulated Fit Coins, streak data, and event progress associated with your account will be permanently forfeited.

15.3 Effect of Termination

Sections that by their nature should survive termination shall survive, including but not limited to: Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law.

16. CHANGES TO THE SERVICE

We reserve the right to modify, suspend, or discontinue any part of the FitStreak Service at any time, with or without notice. This includes:

• Adding, removing, or changing features
• Adjusting the earning rates of Fit Coins or Green Energy metrics
• Changing event formats, prize structures, or eligibility criteria
• Updating third-party integrations

We will make reasonable efforts to notify you of significant changes through the App or by email. Continued use of the Service after such changes constitutes your acceptance of the updated Service.

17. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of  the Republic of India, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts located in Surat,Gujarat, India.

If you are a consumer in the European Union, you may also have the right to use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

18. GENERAL PROVISIONS

• Entire Agreement — These Terms, together with our Privacy Policy, constitute the entire agreement between you and FitStreak regarding the Services and supersede all prior agreements
• Severability — If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force
• Waiver — Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights
• Assignment — You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction
• No Third-Party Beneficiaries — These Terms do not confer any rights or benefits on any third party
